Terms of Service

1. Acceptance of Terms

By downloading, installing, or using ShrimpKeepers, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

You must be at least 13 years old to use ShrimpKeepers. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

2. Account Terms

Account Creation

To use certain features of ShrimpKeepers, you must create an account. You agree to:

• Provide accurate and complete information
• Keep your account credentials secure
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

Account Security

You are responsible for maintaining the confidentiality of your account. I recommend using a strong, unique password and enabling any available security features.

3. Acceptable Use

You agree to use ShrimpKeepers only for lawful purposes. You may not:

• Violate any applicable laws or regulations
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to any systems
• Use the App to harass, abuse, or harm others
• Upload malicious code or content
• Reverse engineer, decompile, or disassemble the App
• Create multiple accounts to abuse free tier limits
• Share your Premium account with others

4. Subscription & Payments

Free Tier

ShrimpKeepers previously offered a free tier, but now offers only paid plans:

• 1 tank limit
• 30 days of parameter history
• Basic features as described in the App

The free tier is provided "as is" and I reserve the right to modify its features.

Premium Subscription

Premium features are available through:

• Annual Subscription: €9.99 billed yearly
• Lifetime Purchase: €24.99 one-time payment

Free Trial

New users receive a 14-day free trial of Premium features. No payment information is required to start the trial. After the trial ends, you will be downgraded to the free tier unless you subscribe.

Payment Processing

All payments are processed through the Apple App Store or Google Play Store. I do not directly handle your payment information. Payment terms are governed by the respective store's terms of service.

Refunds

Refund requests are handled by the Apple App Store or Google Play Store according to their policies. I encourage you to use the free trial before purchasing to ensure the App meets your needs.

Subscription Cancellation

You may cancel your annual subscription at any time through your App Store or Google Play settings. Cancellation takes effect at the end of the current billing period. Lifetime purchases are non-refundable after any applicable refund period.

5. Data Ownership

You own your data. All tank data, parameters, logs, and other content you create in ShrimpKeepers belongs to you.

By using the Service, you grant us a limited license to:

• Store, process, and sync your data to provide the Service
• Create backups to prevent data loss
• Use aggregated, anonymized data to improve the App

You may export your data at any time (Premium feature) and delete your account and all associated data.

6. Intellectual Property

ShrimpKeepers, including its design, code, features, logos, and content, is owned by us and protected by intellectual property laws.

You may not:

• Copy, modify, or distribute the App
• Use our trademarks without permission
• Create derivative works based on the App
• Remove any proprietary notices from the App

8. Limitation of Liability

To the maximum extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of data
• Loss of goodwill
• Damage to property
• Death or injury to shrimp or other animals

In no event shall our total liability exceed the amount you paid for the Service in the 12 months preceding the claim, or EUR 25, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless ShrimpKeepers, its developers, and affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

10. Termination

By You

You may terminate your account at any time by:

• Deleting your account in the App settings
• Contacting us at support@shrimpkeepers.com

By Us

I may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Fail to pay for Premium services

Effect of Termination

Upon termination:

• Your access to the Service will be revoked
• Your data will be deleted according to our Privacy Policy
• No refunds will be issued for unused subscription time (unless required by law)

11. Changes to Terms

I may modify these Terms at any time. When I do:

• The "Last updated" date will be revised
• For material changes, we'll provide notice via email or in-app
• Continued use after changes constitutes acceptance

If you disagree with any changes, you may terminate your account.

12. Governing Law

These Terms are governed by the laws of France, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of France. However, if you are a consumer in the EU, you may also bring proceedings in your country of residence.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ShrimpKeepers regarding your use of the Service.
